Terms of Service
The agreement between you and The Usual.
The short version
- Customers use The Usual free. Businesses pay monthly, per plan.
- Paid plans start with a 14-day free trial. A card is required to start it, and it is charged when the trial ends unless you cancel first.
- Cancel any time. You keep access to the end of the period you've paid for; we don't refund part-months.
- Rewards are promises made by the business, not by us.
1. Agreeing to these terms
By creating an account, joining a loyalty programme, or signing a business up to The Usual, you agree to these terms and to our Privacy Policy. If you're accepting on behalf of a business, you confirm you're allowed to. You must be at least 18 to open a business account and at least 13 to use the app as a customer.
2. What The Usual is
The Usual lets a business run a stamp-card loyalty programme on its customers' phones. Customers join by scanning the business's code. Staff add stamps and redeem rewards by scanning the customer's code at the counter. We provide the software; the business decides what its programme offers.
3. Accounts
Keep your sign-in details to yourself and tell us promptly if you think someone else has used your account. You're responsible for what happens under your account, and a business is responsible for the staff accounts it creates. One person, one customer account.
4. For customers
- Stamps and rewards have no cash value, can't be sold or transferred, and can be used only at the business that issued them.
- The business sets the rules of its programme — how many stamps, what the reward is, whether rewards expire — and is solely responsible for honouring them. If a business closes, leaves The Usual or changes its programme, we can't guarantee its rewards.
- Stamps are added only by the business's staff. Trying to create stamps or rewards any other way — copied codes, automated requests, multiple accounts — may lead to those stamps being reversed and your account being closed.
5. For businesses
- You're responsible for your programme, for honouring the rewards your customers earn, for your staff's use of the app, and for complying with the laws that apply to promotions and marketing where you operate.
- Your customer list for your own programme is yours to export. You'll see a customer's email address only where that customer has opted in to hear from you, and you agree to contact them only on that basis and to honour unsubscribe requests.
- You won't use The Usual to collect customer information for any purpose other than running your loyalty programme.
- Plan limits (locations, staff accounts, active programmes) are those shown on our pricing page at the time you subscribe.
6. Plans, trial and billing
- Prices. Plans are billed monthly in US dollars at the price shown when you subscribe, plus any applicable taxes. We'll give at least 30 days' notice by email before a price change takes effect for you.
- Where you subscribe. Business subscriptions are bought on our website, not inside the mobile app. The app shows your plan and links to the website to manage it.
- Free trial. New business subscriptions start with a 14-day free trial. A valid payment card is required to start the trial. Unless you cancel before the trial ends, your card is charged for the first month on the day the trial ends, and monthly after that.
- Founding businesses. If we've invited you to the founding group, your access is free for the period we agreed with you, and no card is required until that period ends.
- Failed payments. If a payment fails we'll retry and email you. If it remains unpaid, we may suspend the business account — staff won't be able to add stamps — until it's settled.
7. Cancellation and refunds
- How to cancel. You can cancel at any time. Email jack@connect-quick.com from the address on your business account and we'll confirm by reply within one business day; your cancellation is effective from when you sent it, not from when we replied. Once self-serve billing is available, you'll also be able to cancel from the billing page of your account.
- When it takes effect. Cancellation stops your next renewal. You keep full access until the end of the billing period you've already paid for, and you aren't charged again.
- During the trial. Cancel before the trial ends and you're never charged.
- Refunds. Payments are non-refundable and we don't refund partial billing periods, except where the law requires it or where we've charged you in error — tell us and we'll put it right.
- Your data on the way out. You can export your customer list before you go. After cancellation your programme stops accepting stamps; your customers keep their history in the app.
8. Acceptable use
Don't misuse the service: no attempts to get around the scan-code or stamping rules, to access another person's or business's data, to probe or overload our systems, to resell the service, or to use it for anything unlawful. We may suspend or close accounts that do.
9. Our content and yours
The Usual's software, name and branding are ours. Your business name, logo and programme details remain yours; you give us permission to display them in the app, including to people searching for businesses near them, for as long as your programme is live.
10. Availability
We work to keep The Usual running during your trading hours, but we don't promise it will be uninterrupted or error-free, and features may change. The service is provided "as is" and "as available", and to the fullest extent the law allows we disclaim all implied warranties.
11. Limits on liability
To the fullest extent the law allows, The Usual isn't liable for indirect, incidental or consequential losses, or for lost profits, revenue, goodwill or data. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or US $100. Nothing in these terms limits liability that can't lawfully be limited.
12. Ending or suspending accounts
You can stop using The Usual at any time, and customers can delete their account from inside the app. We may suspend or end an account that breaks these terms or puts the service or other users at risk; where we reasonably can, we'll tell you first and give you a chance to fix the problem.
13. Changes to these terms
If we make a change that matters, we'll tell you in the app or by email at least 14 days before it takes effect. If you keep using The Usual after that, you've accepted the new terms; if you don't agree, you can cancel before they apply.
14. General
These terms are governed by the laws of the US state in which the operator of The Usual is established, without regard to its conflict-of-law rules, and subject to any consumer protections you're entitled to where you live. If part of these terms is found unenforceable, the rest still applies. These terms are the whole agreement between us about the service.
